These Terms of Use (“Terms”) govern your access to and use of the ForkSLAP mobile application, web application, and related services (collectively, the “App”), operated by ForkSLAP (“we,” “us,” or “our”).

By accessing or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Eligibility

You must be at least 18 years old to use the App. By using the App, you represent and warrant that:

• "You are at least 18 years of age;"
• "You are not pregnant and not nursing; and"
• "You have been medically cleared by a licensed healthcare professional to participate in a low-calorie, high-protein diet and related weight-loss activities."

If any of the above statements are not true, you may not use the App.

2. Description of the Service

The App provides tools and information related to weight management, nutrition tracking, fitness tracking, and goal setting for general wellness purposes.

We reserve the right to modify, suspend, or discontinue any part of the App at any time without notice.

3. Medical Disclaimer

The App does not provide medical advice.

All content and features provided through the App are for general informational and educational purposes only and are not intended as a substitute for professional medical advice, diagnosis, or treatment.

You should always consult a qualified healthcare professional before beginning any weight-loss, nutrition, or exercise program, especially if you have a medical condition, are pregnant, or are taking medications.

Use of the App is at your own risk.

4. No Guaranteed Results

We do not guarantee any specific weight loss, health improvement, or fitness result. Results vary between individuals based on many factors outside our control.

5. Account Registration and Security

To access certain features, you may be required to create an account.

You agree to:

• Provide accurate and complete information
• Keep your login credentials confidential
• Be responsible for all activity that occurs under your account

We are not responsible for unauthorized access caused by your failure to safeguard your credentials.

6. Payments and Subscriptions

The App is a paid service. By purchasing access, you agree to pay all applicable fees as described at the time of purchase.

Payments are processed through a third-party platform called Stripe.

Subscription terms, billing cycles, renewals, and cancellations are governed by the platform through which you purchased the App

All fees are non-refundable unless required by law or platform policy

7. Acceptable Use

You agree not to:

• Use the App for unlawful purposes
• Attempt to reverse engineer, copy, or exploit the App
• Interfere with or disrupt the App’s functionality
• Use the App in a way that could harm others or yourself

We reserve the right to suspend or terminate accounts that violate these Terms.

8. Intellectual Property

All content, features, designs, text, graphics, logos, and software associated with the App are owned by or licensed to ForkSLAP and are protected by intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes only.

9. Privacy

Your use of the App is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information.

10. Limitation of Liability

To the maximum extent permitted by law, ForkSLAP shall not be liable for any indirect, incidental, consequential, or special damages, including but not limited to injury, health outcomes, lost profits, or data loss arising from your use of or inability to use the App.

Your sole remedy is to stop using the App.

11. Indemnification

You agree to indemnify and hold harmless ForkSLAP from any claims, damages, losses, or expenses arising from your use of the App or violation of these Terms.

12. Termination

We may suspend or terminate your access to the App at any time, with or without notice, if you violate these Terms.

You may stop using the App at any time.

13. Changes to These Terms

We may update these Terms from time to time. Changes will be effective when posted in the App or on our website. Continued use of the App after changes constitutes acceptance of the revised Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Tarrant County, Texas, without regard to conflict-of-law principles.
